If a battered woman tries to poison her husband and instead poisons other people should she still get leniency?

I have a script idea a woman in an abusive relationship decided to poison her husband to death by making cookies with arsenic and cyanide and giving them to him. She also makes a batch of cookies to send to her child's school which is having a bake sale. She accidentally sends the poisoned cookies to her child's school and several children get poisoned and die.
